This document forms part of every accepted proposal issued by The Groutsmith PA–NJ. Execution of the proposal, electronic acceptance, payment of the required deposit, or authorization to begin work constitutes acceptance of these Terms & Conditions.
1. Acceptance of Proposal
Acceptance of any proposal or estimate from The Groutsmith PA–NJ ('Contractor') constitutes acceptance of these Terms & Conditions. By authorizing work to begin, electronically accepting a proposal, or paying the required deposit, the Customer agrees to these terms.
2. Workmanship Warranty
Unless otherwise stated in writing, workmanship warranties are: Grout Color Sealing (1 Year), Clear Sealing (1 Year), Grout Repair/Regrouting (1 Year), Tile Repair & Rebonding (1 Year), Shower Restoration (1 Year), Natural Stone Sealing (1 Year), Traditional Tile Installation (5 Years), Caulking (30 Days manufacturer's warranty). Manufacturer warranties remain subject to their respective terms.
3. Covered Work
This warranty covers defects determined by The Groutsmith PA–NJ to be caused solely by our workmanship. Covered defects will be repaired or replaced at our sole discretion.
4. Exclusions
This warranty does not cover normal wear, misuse, improper maintenance, harsh chemicals, steam or pressure cleaning, impact damage, structural movement, foundation settlement, plumbing or roof leaks, flooding, mold, efflorescence, rust, pre-existing installation defects, customer-supplied materials, work performed by others, acts of God, or normal hairline grout cracking caused by building movement.
5. Tile Installation
Traditional tile installations are warranted for five (5) years against defects in workmanship only. Structural movement, framing deficiencies, moisture intrusion, manufacturer defects, or abuse are excluded.
6. Waterproofing
Where waterproofing is included in our scope, only systems installed by The Groutsmith PA–NJ are covered. Existing waterproofing systems and water intrusion originating outside our work are excluded.
7. Unforeseen Conditions
Hidden conditions such as water damage, rot, mold, structural deficiencies, improper waterproofing, plumbing issues, or unsuitable substrates may require work to stop. Any corrective work is outside the original proposal and requires Customer approval.
8. Change Orders
Additional work beyond the original proposal requires approval and may affect pricing and scheduling.
9. Customer Responsibilities
Customers must follow curing and maintenance instructions, use appropriate cleaning products, and promptly report concerns. Failure to do so may void warranty coverage.
10. Right to Repair
The Groutsmith PA–NJ must be given a reasonable opportunity to inspect and repair any claimed warranty issue before repairs are performed by others.
11. Payment Terms
Deposits are due upon acceptance unless otherwise agreed. Final payment is due upon substantial completion. Overdue balances may accrue interest and collection costs as permitted by law. Deposits may be forfeited for late cancellations where labor or materials have been committed.
12. Limitation of Liability
Our liability is limited to repair or replacement of defective workmanship. We are not liable for incidental, indirect, consequential, or special damages to the fullest extent permitted by law.
13. Dispute Resolution
The parties agree to attempt good-faith negotiation and mediation before litigation where permitted by law. Venue shall be in Pennsylvania or New Jersey based on project location.
14. Entire Agreement
These Terms & Conditions, together with the accepted proposal, constitute the entire agreement between the parties.
Documentation & Marketing. The Customer authorizes The Groutsmith PA–NJ to photograph the project before, during, and after completion for documentation, warranty administration, quality control, training, and marketing purposes. No personally identifying information will be published without permission.
